Model Contracts

Model Contracts as a Starting Point

These model contracts are designed to serve as a “starting point” for anyone seeking to utilize renewable energy resources. The term “anyone” in this context include (but not limited to) active self-consumers, communities, renewable energy companies, and even researchers.

If “you (for example, an individual household electrical user or a factory operator)” wishes to convert sunlight on your roof into electricity for your own consumption by hiring a professional power producer to install and use a rooftop system for you, you can find our model private power purchase agreement here. A power company can provide you with “their model PPA”, but how can you (without hiring a lawyer) be confident that “their model clauses” are fair to you?

If you (for example, an agricultural community with capability to produce electricity from biomass and biofuels)wishes to set up a community-based biomass/biofuel power plant and supply electricity to local users with an aim to become less dependent on fossil-fuel electricity from the national electricity grid. You can find our model private power purchase agreement here. This community can even find our model financing agreement (a loan) to ensure bankability of this power project.

If you (for example, an academic researcher) wish to conduct research on a third-party access (TPA) framework) and answer whether a person has a right to use power grids of state-owned enterprises to transport electricity from its entry point to the exit point, you can find our model wheeling service agreement here. These models reveal the possibility of legal innovation from the ELC Team to push forward energy transition within the context of Thai laws.

ELC’s model contracts are prepared with a clear commitment to the public interest. Simplified model contracts are made “freely available” so that project initiators can use them directly, understand the core legal structure of agreements, and move forward without unnecessary cost or dependence on legal drafting at the outset.
